IMHO MS isn't an overbearing legalist monster like some others. Their EULA specifically acknowledges that the prohibitions are not absolute and that there are permitted uses, which makes it harder to assert EULA breach to justify license cancellation which puts you in jeopardy of public policy and copyright breach. Full credit to MS for that.

My understanding is that the amount in controversy/damages need to exceed $75K to mount a claim in Federal Court- unless there's public policy specifically allowing a claim, e.g. for copyright. Hence earlier credit to MS for not angling at that, and a challenge to assert $75K damages if (for example) somebody fixes the issue referenced in the APPEND GENERAL and Windows 10 thread.
