Not certain, but I think lack of intent was - same as negligence - targeted on running sideways email account. Not for the action of deleting emails IIRC, and if that is/was true, it was brilliant: offering a red herring which shifts the focus away from deleting while fudging the negligence issue with "intent" (adding lack again would sip the irony)
