Other opinion was that since the EULA makes reference to common law exceptions, Chen's bug fixes and "interoperability" are covered by common law and precedent, so are permitted by the EULA. The other consideration was that under US law, to file a claim you need to demonstrate damage, meaning monetary loss or undermined product position caused by the activity. I believe this is one reason why Chen's compiler searches for VFP and won't install without it. It also explains MS's recognition of products like Refox that some would insist are clearly in breach of parts of the EULA. It's popular to criticize MS for this or that, but IMHO MS has not been one of those vendors with deep pockets that practice lawfare to stifle market activity.
