Somebody did once report VFPA to Microsoft for EULA infringement; MS's response was a generic suggestion that legal advice can help if there's ever any question. My own such confirmation says that there's specific common law cutouts for bug fixes and interoperability improvements in most Western jurisdictions, which is actually referenced/acknowledged in the EULA fwiw.
