I agree that Microsoft does not always follow their own guidlines. I disagree with the creativity aspect. We should be designing applications that are easy to use. If we change something that is default behavior in Windows, then our application works differently than other Windows applications. Does that make it easier for the user??? No. I recommend the book "About Face" by Alan Cooper. It is the best book on UI design that I've ever read. Microsoft has also published a book with UI guidelines for Windows. Both are highly recommended.
