Actually a written contract may be modified by a subsequent verbal agreement, or even by subsequent inconsistent behavior by one or more of the parties to the contract.

I would like to see this tested. Examples are one thing, proving it in court is quite another. Certainly, if you take time to have a written agreement, and then make subsequent verbal addendums that are major changes, the word foolishness comes to mind.
