This should always give you a filtered view if SET DELETED is OFF, or SET DELETED is ON and you have an index on DELETED() and SET COLLATE does match the index expressions. If you usually don't get a filtered index, I would be interested to find out why you don't get one. Can you verify that you indeed get a filtered table?
