See if this will work for you. I added a variable that the report has scope of, could be from the calling method or the init of the report de. This variable holds the disclaimer test. Add a report group of EOF() to the report. In the
eof()group footer place the variable with a stretch. Mark the stuff in your page header as print only when ! eof() and remove line if blank.

If this is unclear I'll email you my sample.
