Hi Doug,
I don't think you can do it. I would recommend setting a custom form property that the menu looks at.
SKIP FOR NOT ( TYPE("_SCREEN.ActiveForm.RecordsExist") = "L" ;
  AND _SCREEN.ActiveForm.RecordsExist)
or maybe leave out the NOT, I never get that right.
