That's not like a wrongful termination case (or whatever it's called). I'd say "performance" was not on this person's vocabulary.
I suppose fairness is on the eyes of the beholder (read: the judge).
It reminds me of that lady that filed the suit about foxpro's Y2K non-compliance. I wonder if she's finding any work with all the publicity that the suit got.
