While they are correct that you can't force them to USE the device... they can't force you to take out the code the requires it. Bottom line, if they want to use the software, they have to use the device. I don't think any court in the law will uphold a decision that goes against you enforcing your copyright.
I would stick to my guns... if they are legal, it shouldn't been an issue. I assume it is a non-obtrusive device that doesn't change any other functionality of the PC?
