In a model form, you've got to instantiate the menu's you want to use from within the form itself or else the menuitem will not be available.

Maybe you could try to use PUSH MENU somewhere in the init or load and POP MENU somewhere in the activate event, to use the menu's which are already available for non-modal forms. I have not tested this, but you may find that this works.
