I recall having this discussion on UT before.... but....
I had a client do this on me... once. He kept complaining that the app wasn't 'doing' what it was supposed to do and that
it wasn't useful to him. This was when I used a 50% down and the rest on completion contract. After this event I changed my
contract to make payments on a bi-weekly basis for the previous two weeks work. If they stop paying I stop working.
I was never out more than two weeks work. Worked well. I also had prearranged milestones that they signed off on after an
appropriate testing period and that handledthe usability issue. The first guy to default on me later had a file corruption problem,
caused by a hardware failure, that prevented him running his app. It turned out that he was using it all along and was pleased
with it. He was just a crook at heart and never missed an opportunity to steal if he thought he could get away with it. I received the
past due balance plus an advance before I went to his place of business and restore the app and retrained him and his staff in
proper backup procedures.

>You make a good point Rip, but that doesnt mean they can't take him to court, meaning he would have to spend money to defend himself.

>>I am not a lawyer but if the information Kevin post's is true and he can prove it in court, I think he has nothing to worry about. Your advice is good in that he should be sure what he says is true. If it is not he would definatly be liable for slander, but if it is, I think it is very appropriate for this forum seeing he made the contact here.

>>>Careful with posting information like this in a public forum, I am not sure whether this opens you up to litigation.
