I had a similar problem a few years ago in FP 2.0
Basically as the report is loaded FP seems to lock the header momentarily
giving other users a File is in use message if they try to access it at (exactly) the same time

My solution was to put the report form command in a loop and keep on trying until it gets hold of the report (not long usually).
