That document states only the side of the defense. I would not even attempt to comment on it without seeing the follow-up documents or prosecution's rebuttal that lead to the over turn of the stay of execution. Otherwise, if the assertions in that document were completely founded, then the court would have had the responsibility to commute the sentence or set aside the verdict. To not do so, would have been a gross miscarriage of justice at the appelate [or higher] levels.
