The source code is owned by the person who pays you to write it. Sometimes, even if you write something in your own time but your employer directly benefits from it, they will own it. This is an 'Intellectual Property' issue (something I personally object to). I try to get around this by ensuring I have a use for something, I put it on my website. If a client wants to use it, one of their employees has to download it from my website (not me). That way, I can prove it existed elsewhere as freeware before the client used it.
