They are making the claim because if manual recounts go on, Bush loses. The issue is as simple as that.

FWIW, TX statutes are not binding on FL - regardless of how "iron clad" the statute may appear to be. So while it may be an interesting academic excercise to research, it is a waste of time. Also, FWIW, the tools required to properly research these sort of things are not available to the general public - unless of course you have access to a law library and/or know how to use West or Lexis.
