The US Supreme Court granted Cert on questions 1 and 2. My source is for this is the Supreme Court website, CNN.com/Law. The context of my reply was only in regards to what what the court was granting Cert.

Perhaps they are waiting for the 11th Circuit to rule, since they dismissed did NOT dismiss that question with prejudice, leaving it open for later consideration.
