I myself never tried to distribute MS Agent files with the application.(You noticed that my FoxSpeaker does not contain MS Agent itself). I always use MS Agent installation on user PC as it follows from the MS Agent EULA:

...(b) only allow access to the SOFTWARE PRODUCT by your end-users by 
(i) providing instructions or a hyperlink URL so that your end-user customers
can download the components from Microsoft's Web site located at
http://msdn.microsoft.com/msagent/...

This EULA is also the reason for copyright window appearing when you start FoxSpeaker.
