Not to open another can of worms here, but there is an interview with David Boise on the Napster website in which he outlines the legal reasoning behind Napster's (IMO sound) defense. IMO, Napster has a case, and Boise is a brilliant lawyer.

That's not to say that I don't wish he would sit down and shut up in this whole election deal.
