Agreed, "fairness" is very critical to the American public, and the swing voters in particular. The question in this "Election That Wouldn't Die" is: who is on the better side of the fairness issue here? I don't know the answer to that, Gore had it working for a while but has pushed the envelope a bit too far now, perhaps.

But I will say on the topic of fairness & future elections: there may be a fairly deep pool of latent resentment over the fact that the clear popular vote winner may not be the actual winner in this election. IMO this is a major fairness issue to the public, if not practically useful just now due to our rules-of-law. And this resentment may be the ultimate salvation for the Dems down the road, if they are perceived as being on some sort of witchhunt currently.
