Well, as it stands today, the government does and I agree with that, as do MOST Americans. Until the majority loses it's mind, and that is rapidly approaching, we'll have to live under the current rule of law.
And as you say, if people want to break the law, they can take their chance at getting caught. Of course, that lends itself to stimulating the economy too. So there are beneficial aspects to this illegal drug usage. Lawyers, cops, insurance people, doctors, nurses, judges, etc ad nauseum get in the loop.
