Well, the document stating that I own the software and that he is a licensee, is embedded within the software. Basically, the opening screen has a statement in bold print, which requires that the user/licensee read and agree to the user agreement before using the software. It is made very clear that by using the software, the licensee agrees to all that is stated within the user agreement. Nothing is hidden with this, and it's all out in the open and plain to see.

The client did ask me about one aspect of this agreement, specifically whether he could use the software on his home computer as well as his office computer. Other than that, he mentioned nothing about the fact that I owned the rights to the software. The first paragraph in the user agreement clearly states that I own all rights. Other than that, we never specifically talked about the fact that I own the rights.

Our paper contract did not mention anything about me owning the rights, but it also did not imply that he owned the rights. It simply stated that I was creating a database application designed to manage and analyze the data related to his surgical practice.

Hey, when I become financially viable can I hire you as a legal consultant? ..:)
