I just finished my research on this issue. I have a couple of National Law Journal articles, a few Law Review Articles, and a case that is pending before the US Supreme Court.

As I figured, this is a very hairy and undecided issue.

I am going to cull all of these materials and post them on the Wiki. It will definitely make for good reading. And hopefully, more informed US software developers...
