I'll bite. The ad is an offer. The order is acceptance. But I have a rotten feeling you're going to tell me differently.

You guessed right....I am going to tell you differently...

The info on Amazon, and most catalogs for that matter, are invitations for you to make an offer. When you submit your order, in reality, you are making an offer to purchase a specified quantity of the merchandise at a specified price. If the company accepts your offer, they will process and ship your order. If they don't accept, they will tell you they are out of stock or they don't carry it any more, or whatever...

If they made you the offer and you accepted, then they would be bound by contract. you could technically sue them for specific performance. Imagine the chaos that would be created. The fact is, companies advertise things for sale all of time and they run out of those items. Companies are not contractually obligated to make sure you can actually purchase items from them. Therefore, what they do is invite you to make an offer instead of them making an offer to you. With an offer, you are always free to not accept...
