I am not sure what is in your upload routine. Do you return after the file handle use is done? Have you tested that the windows buffers used in the low level file handling routines are not still active?

Anyways, that is just a guess. Maybe put a short wait after the upload, or stick in a messagebox before the fclose() to see the state of the file handle.
