Actually, no. Opens Source and the GPL are not the same thing, as RMS frequently reminds us. (http://www.gnu.org/philosophy/words-to-avoid.html and http://www.gnu.org/philosophy/free-software-for-freedom.html and http://www.gnu.org/philosophy/free-sw.html. Also, the GPL definition is found here: http://www.gnu.org/copyleft/gpl.html and the Open Source License summary is found here, http://www.opensource.org/docs/definition_plain.html. There are some differences which give propriatary software more wiggle room, (BIANAL) but the Opens Source License is based on the GPL and LGPL anyway. People often confuse the two.)

Microsoft is really warring against the GPL, the General Public License, as described in the URL given above. It is a tactical move because politicans can be convinced that Open Source will damage "Intellectual Property" rights, i.e., their software patents. This is what is scaring the bejezzus out of Microsoft and in confusing the two they may get laws passed which gut both. Thus, they are spreading FUD and disinformation by trying to link the GPL with OpenSource. "Open Source" according to Microsoft is "you can look at (parts of) the code, but you can't touch it", and their user their legal begals to insure that you can't touch it. For a complete description of the evils of patenting intangible things, like alorithms and thought it self, see http://www.fortune.com/indexw.jhtml?channel=artcol.jhtml&doc_id=202216. It describes a real public parasite, and a problem with the patent process which allows someone like him to file an ambiguous patent and fill in the missing pieces as others do the actual work. The patent applies from the data of application, which may preceed the date real works was done by years, thus legalizing theft of rights the actual creator should have. The real question is: who else is doing this? How can we stop it?
