This would likely fall under the area of fair-use. But this too has limits. For example, in our 6 book, we wanted to use the Fox logo on the cover. Prima either did not want to engage MS or MS did not want to set a precedent by allowing a 3rd. party publisher to incorporate a tradmarked logo. I suspect the latter was the case.

The Fox logo is used all over the place on the web. And, if the logo is used in conjunction with promoting the product (Fox) in a generic sense, I don't see a problem with that. OTOH, if somebody were to use the logo in such a way that makes it appear as if it were their logo, that would be a problem. BTW, the issue does not turn on whether you are trying to profit from the use. The issue turns on whether you represent the property as your own.

Ultimately, it boils down to the fair-use doctrine...
