I'm not sure if you read the documentation for the Points system but it is quite fair.

The creator of the thread can mark the message as the answer. If not, for any kind of reasons (too busy, will do it later, forgot, not aware of points system, etc.), then, if you get a confirmation that you have given the answer, just force the message to be marked as a solution of the thread.

There is nobody which is assigned to judge who is smarter than the other one. The points are given by the members. So, if you think you should get some, just mark the messages.
