Technically, of course, you are correct.
But the fact of the matter is that now, to learn what options exist, you actually have to "go" into a mode where an option might be applicable.
I personally consider "contextual menus" in the same light as changing button captions on the fly. Namely, sexy design but genuinely unhelpful.

There would be nothing wrong, I suppose, with having them where they are but, in addition, have some setup options or some super-menu to let us know what ALL is available, all in one place.
