Years ago I was a manager for Burger King. In the marketing and operations manuals were very stringent rules detailing what you could and couldn't do with the logo. You basically couldn't alter it at all; had to be the same font, same ratio of height vs. width.
IMHO most people don't read anymore and even when they do they don't understand what they read. All they will see is the different fox head.
Yes, I think MS would still complain.
