I can at least duplicate the behavior you are seeing. I've tried a couple of things but they don't seem to fix the problem.
Do you have to use SDI forms?
Did you see the code in the toolbar.cmdMenu.Click() that actually moves the controls around by the menu height when the menu is added. You may have to do something similar when the toolbar is docked left or top.
