But I truly thought (think) that the duty of the courts is PRECISELY counter-majoritism (to use your phrase) - to ensure that the CONSTITUTION protects everybody's rights and specifically NOT the majority's will.
Democratic government ensures that the will of the people is executed and the judiciary ensures that that will does not trample individuals' rights.
Your premise seems to be that majority rules for everything. That is counter to the design objective of your governmental structure, which is specifically aimed at protecting the rights of EACH individual.
