Why would I be joking? Somebody had to tell them. Do you think they just stumbled on it? Granted, it is a possibility, but a remote one. Somebody brought it to their attention.

Well, if assumptions are present in regards to who initiated the content to MS, which would have then leaded that to us from MS legal, doesn't concern us. What is important for us is that MS legal forwarded their request to the Fox team and they called us to express their concern.

I still would have argued fair use. IMO, it is a fairly strong argument.. Did you try arguing fair use?
