In fact, Michael Jackson owns the rights to the "traditional" Happy Birthday (which was written by two sisters, and isn't all that old). However, I don't individuals would be sued for signing it. I believe there have been cases involving restaurant employees; that's why so many of the restaurant chains have their own birthday songs.
