About that third file, I have a setup for the runtime libraries that includes an 8 Kb executable that does nothing but show a messagebox saying the setup completed successfully, I suppose that covers the part of distributing it with an application.

You doubt the legal aspect of that third file. Personally, I think if it's downloadable on the same webpage as the other two, than there won't be a real problem. Anyway, I might decide to create only variants 1 and 2. Wonder what MS thinks of this...
