That's an interesting story. I investigated on this last year. I obtained some legal advices as well as FPA's opinion and feedback. Despite the fact that a vendor is allowed to allow a specific client to advertise or not, there is a lot of related issues that get involved in such an action. For that particular and similar cases, I've been told that FPA refuses a competitor to advertise. "Competitor" here refers as per FPA definition. One could say it's not but if they say it is, you're out. The legal aspects regards to the state of California and how they would deal with such an issue where a client is refused access to advertise into a specific publishing without any other specific justifications than the term "Competitor" and how this is interfering with the liberty of advertising. A very complicated issue it is and only changes will apply when one would really push it far enough to change things, if applicable and successful. I've always had trouble to deal with that. Essential Fox and other conferences are out of any possibility to advertise in FPA. This is really sad.
