I think this is a bug. I see a slightly different behavior than you describe, though.
In my testing the graphical checkbox backcolor is the same as the form backcolor. The Backstyle = 0 (Transparent) setting has no effect for a graphical checkbox. If the checkbox has focus or is checked (i.e. down), it takes the correct color.
For me, this is independent of the presence or absence of themes, and happens in VFP7 also.
