Hi Jordan,
You mention that some of your programmers were hired. May be he/she reproduce some part of the code with little modification. For you will be very difficult and time cost to prove your rights.
If you do not like to lose the client, try to attract them with new version, where old things stolen from your ex-worker will be unusable.
