My own take on this is that version 7 may have intended what is clear in version 8, but didn't say it very well. "replaces and/or supplements"? I choose 'supplements'.
Whether or not MS can make a case under version 7 is really not the important issue right now. Version 8 clears up the intentions (mostly). I don't like it, but at least it's quasi-clear. Now I have to make a decision.
Still, it's unfortunate that contract drafters can't ever say what they really mean, and feel the need to use meaningless phrases - in version 7 "and/or" (a phrase which judges hate with a passion), and in version 8, 'a reasonable time'.
