Ken, sorry about it, but the EULA for 7.0 WAS very different. Not so much at the part about upgrade, but at the very begining:
1. LICENSE TO USE SOFTWARE PRODUCT.
1.1 General License Grant. Microsoft grants to you as an individual, a personal, nonexclusive license to make and use copies of the SOFTWARE PRODUCT or ANY PRIOR VERSION for the same operating system, solely for the purposes of designing, developing, and testing your software product(s).
This sounds to me VERY different from the new EULA situation. So, definitely it´s not continuation of the former policy, but major change!
MSDN would somehow solve the problem till VFP7 remains included, but sales of MSDN would harm the VFP sales figures, wouldn´t them?
