Only MS can answer about whether they'll be enforcing it, but I don't see that it makes a difference. You certainly can't count on it not being enforced. Even if you could, it's clear that you know that's not an acceptable way to go anyway. I think all you can do is to make the situation clear, and make sure that anyone caught violating the EULA will be subject to discipline. Is torture still legal in government institutions? Threaten them with 48 hours of old Barry Manilow music.
