This is already the case for many used cars. In Utah, the dealer must clearly label this, or specify what is under warranty if one exists.

That's pretty much the case now, although if there is a manufacturing flaw, they could be held liable. However, manufacturing defects is a very small percentage of traffic deaths. Certainly if I'm drunk and kill someone, the manufacturer is not at fault.

Umm.... every car dealer I've ever been to has tried to sell be a maintenance agreement. Isn't that the same thing?

You can turn in your car on a newer model anytime you want. You can "upgrade", in which case you turn in the old car or you can get the new one outright.
