FWIW, i never trust _TALLY as a mean to check for records in SQL queries. My guess is that depending on the query you are trying to run, _TALLY may get updated many times by the internal system, and a subquery could overwrite the results of the main query etc...
I don't see why not to use reccount() on the cursor after it's built.
