Hmmm. Does that mean that we should go about claiming more incidents as 'criminal'?
And in such a case how is that to be done... a witchhunt?
I look at the "friendly fire" incident that killed 4 Canadian soldiers in Afghanistan. Is that the calibre of a world court action?
The bunker bombed in Gulf War I no doubt had civilians in it, but apparently it also had military command facilities/personnel in lower levels. Is its bombing a world court affair?
The Chinese Embassy in Belgrade was erroneously bombed due to outdated maps. Is that a world court actionable event?

Going around indicting people/organizations from powerful countries just to make a point loses the whole meaning of "justice", at least as I see it.
