"Given to him?" Did he get the Win93 license material? The certificate? He obviously didn't get the disks. It could be that he has an illegal copy. Not that it was malicious...just that the license wasn't properly transferred.

But...given that you are seeking to buy a "legitimate" copy to make things right, you should be ok.

FYI, discontinuing a product does not invalidate the copyrights.
