Sorry guys!
this has nothing to do with sys(3099,70/80) issues
my "temporal" solution is:

copy to ... (into a table)
issue the select on the created table
erase the created table

works nice

I would still be happy to know what is the reason
for this supposedly undocumented behaviour change
and if exists a more "elegant" solution
to handle it.
