'Fairness' is not a subjective term at all. 'Beauty' is not a subjective term either. 'Criminal'... 'Tall'... and so on. None of these terms are subjective in itself. Sure, one person may say that it is a tall building, where the other may say it's not, but that's not to say that tall things don't exist. Tall is a word that's very useful in our language. Fairness is also a VERY useful word.
By not agreeing with Jay you give the impression that you don't care about fairness in this case. I know that you do, why not simply agree on this one. I was not suggesting that it would imply that you and Jay agree on what's fair and what's not.
