It's your choice. But it's not good to assume that the user doesn't know... :) What I can tell you for sure: I never open again a program that changes the system settings by itself! I consider this to be rude :) and, more important, dangerous. If it changes the system without asking me, that means the producer doesn't know the basic rules. So, I can't trust the program.
I never did it, but I think you can use the GetDeviceCaps() Win32API function to detect the number of colors. But I don't know how you can use it in a browser.
