Tracey, I think your mixing apples and oranges. The ICC is intended to try issues concerning International law not your garden variety criminal activities. War crimes and Crimes against Humanity are always the province of the defendent's home country first. Only after the home country fails/refuses to act can an international authority act. Since Bush and company recently extorted the Belgians into closing their courts to these types of cases (Shabra and Shatilla surviors vs. Sharon), there is currently no venue in which to try them.
